Terms of Service
These terms govern how your organisation uses the NoSix platform. Please read them before you create an account.
Version 1.0. Effective 11 October 2026.
1. The agreement
These terms are an agreement between NoSix (“NoSix”, “we”, “us”) and the organisation that creates an account (“you”, the “Customer”). They apply from the moment you tick the box at registration or first use the service.
If you accept on behalf of an organisation, you confirm that you are allowed to bind it.
The service is for businesses and organisations, not for consumers.
The Data Processing Agreement is part of these terms. Our Privacy Policy explains how we handle personal data as a controller.
If you have a signed agreement with NoSix, for example for the Enterprise plan, that agreement prevails where it differs from these terms.
2. The service
NoSix is a web platform for recording facilities and equipment, calculating and reporting emissions and reviewing reduction recommendations, with an AI assistant. The features and limits of each plan are shown on the Pricing page.
We may change the service as it develops. We will not materially reduce the core functions of a paid plan during a period you have already paid for.
3. Accounts and users
- Give accurate registration details and keep them up to date.
- You decide who in your organisation gets access and with which role. You are responsible for what your users do in the service.
- Keep sign-in details confidential. Tell us straight away at hello@nosix.co if you suspect unauthorised access.
4. Plans, fees and payment
- Prices are in euros and exclude VAT and other taxes.
- Paid plans are billed in advance for each billing period and renew automatically until cancelled.
- You can cancel at any time. Cancellation takes effect at the end of the current billing period. Fees already paid are not refunded, unless the law requires it or these terms say otherwise.
- Plan limits, such as the number of facilities and of bills read automatically, apply per billing period.
- We may change prices. We give at least 30 days’ notice by email, and the change applies from your next billing period. You can cancel before it takes effect.
- If a payment fails, we tell you. If it is still unpaid 14 days after our notice, we may suspend access until it is paid.
5. Your data
- You keep all rights in the data and documents you add to the service (“Customer Data”).
- You give us permission to host, copy and process Customer Data only as needed to provide, secure and support the service.
- You are responsible for the accuracy of Customer Data and for having the right to add it.
- You can export your data, or ask us for an export, while your account is active and for 30 days after it ends.
- We may use aggregated data that identifies no organisation and no person to maintain and improve the service.
6. Acceptable use
You will not:
- break the law or infringe the rights of others;
- upload malicious code or try to gain unauthorised access to the service or its systems;
- disrupt the service or test its security without our written consent;
- copy, resell or reverse engineer the service, except where the law allows this despite a contractual ban;
- use the service to build a competing product;
- add special categories of personal data, or personal data the service does not need.
7. Calculations and AI features
Emission figures are calculated from the data you provide and from published emission factors. They are estimates, and their quality depends on the quality of your data.
The AI assistant and the recommendations can contain mistakes. Check outputs before you rely on them, publish them or base investment decisions on them.
The service does not replace professional advice, an audit or third-party assurance. You remain responsible for your reports and for meeting any reporting or legal duty.
8. Intellectual property
NoSix and its licensors own the service, including its software, design, methods and documentation. For the term of the agreement you get a non-exclusive, non-transferable right to use the service for your internal business purposes.
If you send us feedback, we may use it freely and without obligation to you.
9. Confidentiality
Each party keeps the other’s non-public information confidential, uses it only for the agreement and protects it with reasonable care. This does not apply to information that is public, was already known, was developed independently or must be disclosed by law.
10. Availability and support
We work to keep the service available and secure, but we do not promise uninterrupted or error-free operation. We may carry out maintenance and try to plan it outside working hours.
Support is provided by email at hello@nosix.co. Service levels apply only if agreed in writing.
11. Liability
- Nothing in these terms limits liability for intent or deliberate recklessness, or any liability that cannot be limited by law.
- Subject to that, each party’s total liability for all claims arising in a calendar year is limited to the fees you paid or owed for the service in the 12 months before the event that caused the damage.
- Neither party is liable for indirect or consequential loss, such as lost profit, lost revenue, lost data or reputational damage.
- Except as stated in these terms, the service is provided as is, without further warranties.
- Neither party is liable for failures caused by events outside its reasonable control.
12. Term, suspension and termination
- The agreement runs for as long as you have an account.
- Either party may end it in writing with immediate effect if the other materially breaches it and does not fix the breach within 30 days of notice.
- We may suspend access if that is needed to protect the service or other customers, or if you breach the acceptable use rules. We tell you as soon as we reasonably can.
- After the agreement ends, you can export your data for 30 days. We then delete Customer Data as described in the Data Processing Agreement.
- Provisions that by their nature should continue, such as confidentiality, liability and governing law, continue after the end.
13. Changes to these terms
We may update these terms. For material changes we give at least 30 days’ notice by email or in the app. If you do not agree, you can cancel before the change takes effect. Continued use after that date means acceptance.
14. Governing law and disputes
Dutch law governs the agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
The parties first try to resolve a dispute by talking to each other. If that fails, the dispute goes to the competent court in the Netherlands, unless mandatory law says otherwise.
15. General
- You may not transfer the agreement without our consent. We may transfer it as part of a reorganisation or sale of our business.
- If part of these terms is invalid, the rest remains in force.
- Your own purchasing or other terms do not apply.
- If a translation of these terms differs from the English version, the English version prevails.
- Notices to NoSix go to hello@nosix.co. We send notices to the email address of your account owner.
